Updates to NY Certificate of Need and Self-Certification Rules

In a recent development in New York medical construction projects, the New York State Department of Health updated the Certificate of Need process to simplify the approval process. Of some interest, one of the updates relates to architectural self-certification and allows for an architect to self-certify on projects up to $30 million eliminating the need for department architectural review. This is consistent with a law enacted in 2024 in New Jersey, New Jersey Design Professional Self-Certification Act, which allows for design professionals to self-certify for UCC plan review for specific projects.
