With broad experience representing owners, construction managers, general contractors and trade contractors, Mr. Winkles·has knowledge of·all stages of the construction process. This experience includes familiarity with contract negotiation and drafting, contract administration and dispute resolution. His practice includes reviewing, negotiating and preparing construction contracts and general conditions. He has experience with both public and private projects in New York and New Jersey, including projects relating to public schools, universities, office buildings, condominium buildings, residential construction, sewer main systems, and other various commercial and municipal projects.
Litigation, construction and arbitration experience with all issues that traditionally arise in construction disputes, including defects and claims for extra work, delay and disruption issues (including actual and constructive acceleration and claims for lost productivity), incomplete or defective design, inadequate and uncoordinated project management, differing site conditions, cardinal change, denial of site access, improper inspections, safety violations, rejection and repair of nonconforming work, terminations for default and convenience, lien and bond issues, and post-completion warranty issues. Mr. Winkles has argued appeals on construction and bidding issues in New Jersey and in New York, and has handled litigations in the Federal Courts in both New York and New Jersey.
