Land Use

Today, federal, state, and local governments regulate the growth of construction through a complicated systems of laws, ordinances, and municipal development plans. Tesser & Cohen assists its clients in navigating the complicated regulatory system by providing representation at local planning and zoning board meetings, negotiating with governmental agencies, and advising clients on the current state of land use requirements.

In addition to zoning and planning advice, Tesser & Cohen also provides representation in land use litigation.  Representative litigations involve the improper denial of building approvals by governmental authorities, eminent domain disputes, and complicated issues regarding a company's use of land that affected neighboring properties. In these settings, judicial determination and enforcement of private land-use arrangements reinforce public regulation and achieve forms and levels of control that zoning does not contemplate.
